Terms of Service and End User Licence Agreement

Effective Date: October 15, 2026

Welcome to MindLoop ("App"). MindLoop is operated by Nickie Archua, an individual (sole trader) trading as "CachePile", based in the Philippines ("we", "us"). These Terms, together with our Community Guidelines, are the End User Licence Agreement (EULA) between you and us for the App. By installing or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Description of Service

MindLoop is a mindfulness and affirmation application that lets you:

  • Sign in with Google, with an email/password account, or, on iPhone, with Apple (via Firebase Authentication).
  • Write personal affirmations and convert them to spoken audio. Audio is generated by our server-side backend using Google Cloud Text-to-Speech.
  • Save affirmations, playlists, and generated audio, and play relaxing background tracks.
  • Purchase optional premium plans ("MindLoop Plus") and character top-ups.
  • Use the MindLoop Feed, where you can share affirmations publicly under a handle, listen to and save other people's affirmations, and join comments. Section 13 sets out the rules for the Feed.

Sign in with Apple and the MindLoop Feed are part of MindLoop for iPhone version 1.1.0 and later. MindLoop is currently an iPhone app. An Android version is not available yet; where these Terms mention Android or Google Play, that part applies only once it is.

2. Accounts & Security

  • Account options: a Google account, an email/password account, or, on iPhone, an Apple account, managed by Firebase Authentication.
  • Your responsibility: you are responsible for safeguarding your account credentials and device passcode.
  • Cross-device data: your subscription, credit balance and Feed activity are associated with your account. Your affirmations, playlists and generated audio are kept on your device and backed up to your account so they can be restored when you sign in. Our Privacy Policy explains what we store.

3. Subscriptions, Billing & Refunds

  • MindLoop Plus is offered as monthly and yearly auto-renewing subscriptions, plus a consumable character top-up, through Apple App Store Billing and Google Play Billing.
  • Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel anytime in your Apple App Store or Google Play account.
  • Credits: paid plans grant a character allowance used for audio generation, with expiry terms shown at purchase. Credits are consumed when you generate audio.
  • Credits require an active subscription: character top-ups can only be purchased while a MindLoop Plus subscription is active, and any unused credits — including top-up credits — are forfeited when your subscription ends or is cancelled. The app reminds you of this before you cancel.
  • Refunds are governed by the respective App Store's refund policies (Apple App Store or Google Play).

4. Generated Audio & Acceptable Use

  • Processing: affirmation text you submit is sent to our backend and to Google Cloud Text-to-Speech to generate audio.
  • Acceptable use: you agree not to submit text that is unlawful, abusive, harassing, hateful, defamatory, or infringing. We may suspend generation features for accounts that violate these standards. Anything you share on the Feed must also follow Section 13 and the Community Guidelines.
  • No warranty on outputs: generated audio is provided "as is"; we make no warranty as to its tone, naturalness, or suitability.

5. Intellectual Property

  • Your content: you retain ownership of the affirmation text you write. For your personal library, we use it only to provide the service (including generating, backing up and caching your audio). Section 13.12 explains the permission you give us when you share content to the Feed.
  • App content: the App's interface, designs, the MindLoop lotus logo, branding, background music, and code belong to us and our licensors.

6. Disclaimers & Limitation of Liability

  • Wellness disclaimer: MindLoop is a self-help tool, not a medical device, and does not provide medical or psychiatric advice.
  • As-is: the App is provided "as is" and "as available" without warranties of any kind.
  • Limitation: to the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the App.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which explains what data we collect and how we handle it. By using the App you acknowledge that Privacy Policy.

8. Termination

You may stop using the App and delete your account at any time (see the in-app Delete Account option or our Account Deletion page). We may suspend or terminate access if you violate these Terms or use the App unlawfully, and we may restrict your use of the Feed as described in Section 13.8. Sections that by their nature should survive termination (e.g. intellectual property, disclaimers, limitation of liability) will survive.

9. Governing Law & Disputes

These Terms are governed by the laws of the Republic of the Philippines, without regard to its conflict-of-law rules. You agree that any dispute arising from these Terms or the App will be subject to the courts of the Philippines, except where applicable law grants you the right to bring proceedings in your own place of residence. Nothing in these Terms limits any mandatory consumer-protection rights you have under the law of your country of residence, or your right to bring proceedings for breach of contract.

10. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with the Community Guidelines and the Privacy Policy, constitute the entire agreement between you and us regarding the App.

11. Changes to These Terms

We may modify these Terms. Material changes will be reflected by updating the Effective Date and/or an in-app notice. Continued use after changes constitutes acceptance.

13. The MindLoop Feed

13.1 What the Feed is

The Feed is a place to share affirmations under a handle, listen, save posts and join comments. Public sharing is different from keeping an affirmation in your personal library. The Community Guidelines are part of these Terms. Read Child safety, Help for you and your family and Reports and complaints too; the Reports and complaints policy forms part of these Terms.

MindLoop has zero tolerance for objectionable content or abusive users. Do not use the Feed to harm, exploit, threaten or harass anyone. We apply the same rules to everyone. Zero tolerance describes what is prohibited and how we act on violations; automatic checks do not find every harmful item.

13.2 Illegal content

  • Terrorism: do not support, promote or encourage terrorism or a proscribed organisation (an organisation banned under terrorism law). The text checks in 13.6 apply before publication; identified violations are removed. Accounts that post terrorism content are removed from the Feed. If we have reasonable grounds to believe an account is run by or for a proscribed organisation, we close the MindLoop account, including sign-in.
  • Child sexual exploitation and abuse: do not sexualise, groom or exploit children, or share links to child sexual abuse material. The checks in 13.6 apply before publication. Identified content is removed as soon as found. Accounts that post child sexual exploitation or abuse content are removed from the Feed.
  • Other illegal content is prohibited. This includes content that breaks laws against threats, harassment, stalking, stirring up hatred, encouraging or assisting suicide or serious self-harm, threats to share intimate images, fraud, scams, and illegal drug or weapon sales. It also includes intentionally asking for a fake intimate image of another adult without their consent and without a reasonable belief that they consent. MindLoop's rules go further: requests for fake sexual or intimate images of real people, and selling drugs or weapons on the Feed, are not allowed even where a particular act would not be illegal. Other priority illegal content and any other unlawful content are also prohibited. These rules use the checks and response process below.

13.3 Content harmful to children — four kinds that are never allowed

  • Pornographic content. Pornographic or other prohibited sexual content is not allowed. Unless the self-harm stop in 13.6 applies, a sexual-content flag holds the item for a person before it can appear. Material that gets through is removed when identified as breaking this rule.
  • Suicide. Content encouraging, promoting or giving instructions for suicide is not allowed. A self-harm flag stops publication and opens support. Material that gets through is removed when identified as breaking this rule.
  • Deliberate self-injury. Content encouraging, promoting or giving instructions for deliberately injuring yourself is not allowed. A self-harm flag stops publication and opens support. Material that gets through is removed when identified as breaking this rule.
  • Eating disorders. Content encouraging, promoting or giving instructions for an eating disorder or eating-disorder behaviours is not allowed. The automatic check treats these as self-harm: a flag stops publication and opens support. Material that gets through is removed when identified as breaking this rule.

13.4 Other harmful content that is not allowed

For each kind below, the text is checked before publication. A flag holds it for a person unless the self-harm stop in 13.6 applies, and identified violations are removed.

  • Targeted abuse: abuse targeting someone's race, religion, sex, sexual orientation, disability or gender reassignment.
  • Hatred: content stirring up hatred because of race, religion, sex, sexual orientation, disability or gender reassignment.
  • Serious violence: encouraging, promoting or giving instructions for serious violence against a person.
  • Bullying: serious threats, humiliation, degrading attacks or a campaign against someone.
  • Graphic harm to people: showing or describing real or realistic serious violence against a person, or serious injury in graphic detail.
  • Graphic harm to animals or fictional creatures: showing or describing real or realistic serious violence against an animal, graphic serious injury to an animal, or realistic serious violence or graphic serious injury involving a fictional creature.
  • Dangerous challenges: encouraging, promoting or giving instructions for a challenge or stunt highly likely to seriously injure someone.
  • Harmful substances: encouraging someone to swallow, inject, inhale or otherwise take a physically harmful substance, or a harmful amount of any substance.

For bullying and graphic harm, you can use the report reasons in 13.7 that put content on hold for review straight away; blocking is also available.

13.5 If you're struggling, you're welcome here

Do not shame people's bodies, tell other people there is no hope, or tell them to stop medical or mental-health treatment. Talking about your own feelings, struggles or recovery is welcome. The automatic checks may miss these kinds of harm, so please report them. A person decides whether reported content breaks these rules. These protections apply to everyone; MindLoop does not show adults a separate, less protected Feed.

13.6 Automatic checks

Before a post appears, its affirmation text, caption and tags are checked together by OpenAI's Moderation API and a banned-word list. Each comment gets the same text check. The automatic check looks for sexual content, sexual content involving children, harassment, hate, violence, instructions for illegal acts and self-harm. If the check fails, the item waits for a person. If it succeeds without a self-harm flag, any other flag or a banned-word match holds the item for a person to decide before it appears. A self-harm flag follows the stop described next, even if another category is flagged too. An item that passes can appear without a person reading it first. Handles use reserved-name and offensive-word lists, not this check. MindLoop generates the spoken voice; the Feed has no photo, video or user-recorded audio upload.

If the check flags self-harm, the submission is not published and the app shows a support screen. The provider's self-harm categories include suicide, self-injury and eating disorders. This can happen when someone is talking about their own distress, even though sharing feelings is welcome. If the same result also flags sexual content involving a child, harassment (including threats), or violence (including graphic violence), we keep the submission and account details for a person to review. Other stopped submissions are not kept as Feed posts or comments; we keep account-level counts and times of stopped submissions. These checks can miss harmful material or misunderstand safe words. If you think a check got it wrong, email mindloop@cachepile.io (see 13.10).

13.7 Reports and review holds

A report using Someone might be in danger, Harassment or bullying, or Sexual or graphic content takes a published post or comment off the Feed for review. Three new reports from different people since the last human review also trigger a hold. A hold is a pause while a person decides, not a finding that the writer broke a rule. The writer sees a message saying the content is waiting for review or being checked. We never tell the writer who reported it. Reporting an account does not by itself remove all its content.

A person reviews every report, usually within 24 hours, and removes content found to be illegal or against these rules.

13.8 What we can do about rule-breaking

A person can remove rule-breaking posts or comments and restrict accounts, including a temporary or permanent ban on posting and commenting. A posting ban does not block every other Feed action. A ban may also hide other posts and comments by that account. If the ban is lifted, those posts and comments can return. Lifting a ban does not undo a person's separate decision about a post or comment, for example to keep it down because it breaks a rule. Content removed by its author, or belonging to a deleted account, does not return. Content with a report still waiting for review stays hidden until a person decides. The post or comment that led to the ban returns only if we choose to restore it. Copies already removed from other people's libraries do not automatically return.

We restrict accounts that post prohibited content; illegal-content violations can lead to removal from the Feed.

13.9 Age

You must be 18 or older to use the Feed. On a real iPhone with iOS 26 or later, MindLoop asks Apple for your age range. A range entirely below 18 keeps the Feed closed; a range starting at 18 or above lets you continue without making a separate age statement. If the range is not shared, unavailable or crosses age 18, the app normally asks you to confirm you are 18 or older before first entering the Feed. Earlier iOS versions use that confirmation too. If a previously shared range of 18 or above changes to under 18 during a visit, the block takes effect on the next app launch. These are age-range and self-declaration checks, not proof of everyone's age.

Some store checks require you to set up your age range first. On iOS 26.2 or later, when Apple reports that this is required in your region, a missing range or failed check keeps the Feed closed once that regional result is known, unless the app is still using an earlier result that says you are 18 or older. A range crossing 18 still uses the confirmation. iOS 26.0–26.1 cannot read that regional requirement. There can be a brief fallback to the confirmation before the regional result arrives. If the range is wrong, check the birthday on your Apple Account (Settings → your name → Personal Information); it sets the age range Apple shares. For a child's account, a parent or guardian can update the birthday by signing in to that account on the web. Then use Check again. You can also email mindloop@cachepile.io. A shared device uses the age information of its Apple account, which may differ from the MindLoop user's age. MindLoop stores the age-range record on your device. It does not send that record to MindLoop's server or include it in MindLoop Library Backup. Your device's own backup settings are separate.

If we have reason to believe an account belongs to someone under 18, we remove it from the Feed. If you think that is wrong, email us to ask for another look.

13.10 Reports, complaints and appeals

You can report or complain by emailing mindloop@cachepile.io, even if you have no account or cannot enter the Feed. This covers reports of illegal content or content harmful to children, complaints about how we meet our safety duties, and complaints about content removals, warnings, bans, other restrictions, mistaken age checks or automatic checks. Say what happened and what you would like us to look at. Reports and complaints explains possible outcomes, response times and how to ask for a faster complaint review.

You can submit one in-app appeal for a hidden post or comment, or one per ban where the ban-appeal screen is available. We take another look and can restore the item or keep the decision. Email us if the in-app route is unavailable, if an automatic check prevented publication, or if the dispute is about age or another restriction. A held submission does not have the hidden-item appeal button. The single in-app appeal limit does not remove your right to complain about our compliance or bring legal proceedings for breach of contract. If you disagree with a decision we make about your content or account, you can ask us to look again as described above, and you can also take the matter to a court in your country. If you are in the European Union, MindLoop and the EU Digital Services Act explains how to send a notice of illegal content and how authorities can contact us.

Intimate images. MindLoop does not accept photo or video uploads, but you can still report intimate image content or related abuse. Email mindloop@cachepile.io with "Intimate image report" in the subject. Say that the content is intimate image content, whether you are the person shown or acting on their behalf, that you make the report in good faith and believe it to be true, where to find the content, and how to reach you. You do not need an account, and you do not need to send an image, an identity document or proof of your relationship to anyone. Do not send a copy of a sexual image of a child. The full instructions and declarations are in Reports and complaints.

13.11 Blocking

You can report or block from a post, comment or author menu. A block is not announced to the other person; it hides your content from each other and stops interactions on each other's posts. Saved copies may remain until a later successful check; removal is not instantaneous, and copies removed from a library do not return automatically after restoration or unblocking. Help for you and your family explains blocking, reports, appeals and support.

13.12 Your content on the Feed

You keep ownership of your words. By sharing to the Feed, you allow us to store, check, display and speak that content, and allow other users to listen and save it through the app. Removing a post stops its public availability, but moderation records and some copies can remain. This permission is limited to providing and protecting the service; it does not transfer ownership.

13.13 Not medical or emergency care

The Feed does not provide medical advice or emergency care. You can talk about difficult feelings here. You do not have to publish your experience to ask for help. For support options, see Help for you and your family.
